Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Welcome Business” Sweepstakes ("Sweepstakes") will begin at 12:00:01am EDT (“Eastern Daylight Time”) on June 23, 2008 and end at 11:59:59pm EDT on December 1, 2008 ("Sweepstakes Period"). Sweepstakes is sponsored by Image Direct, 12424 Wilshire Blvd., Suite 1130, Los Angeles, CA 90025 (the “Sponsor").
Eligibility: The Sweepstakes is open to all legal residents of the contiguous 48 United States and the District of Columbia (excluding Hawaii and Alaska), age 18 or older as of 6/23/08. The participant must be a Welcome Business USA Member. If not already a Welcome Business USA Member, the participant can enroll as one by going to www.welcomebusiness.com; there are no costs to join and no obligations of membership. Employees and families (spouse, children, siblings, parents, and their respective spouses or persons living in the same household of each of those listed) of Sponsor and its respective parent company, subsidiaries, affiliates, franchisees, licensees, dealers and their respective employees, brokers and sales associates and advertising and promotional agencies are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry will be deemed ineligible and any prize awarded shall be revoked. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed or restricted by law.
How to Enter: Participants can enter by simply completing the registration page located at http://www.welcomebusiness.com. All entries must be received by 11:59pm EDT on December 1, 2008. Only one entry per person is allowed during the sweepstakes period. All entries become the property of the Sponsor. Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries.
Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator. All entries become the property of the Sponsor and may not be acknowledged or returned.
Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the declared winning entry will be the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Grand Prize: There will be one (1) Grand Prize awarded. The Grand Prize winner will receive a Phaser® 6110MFP from Xerox and Peachtree by Sage Complete accounting package. The Approximate Retail Value of each Grand Prize is $868.99. All prizes are subject to availability. Only the listed prize will be awarded. Prizes are not exchangeable, transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available.
Drawing and Notification: The Grand Prize winner will be selected, from among all eligible entries received, in a random drawing on or about December 10, 2008 by The American Sweepstakes & Promotion Co., an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. Winner will be notified by telephone and/or mail, or other home delivery service. Upon initial notification and verification of potential winner, each winner will be sent confirmation in writing via USPS mail, or other home delivery service of sponsor’s choice.
Prize Conditions: The Grand Prize winner is solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. The winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release and return it within 14 days of written notification by mail or prize may be forfeited and an alternate potential winner selected. Return of any prize notification as undeliverable will result in disqualification and an alternate winner will be selected. The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited by law) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Entrants also consent to the use of the personal data they submit online to be used by the Sponsor in accordance with its Privacy Policy. Winners and entrants also agree to release, discharge, indemnify and hold harmless Sponsor from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law.
